Notes:

  • Loading/unloading charges for vehicle (boat) – vessel direct delivery shall be calculated by adding the charges for vessels` hold to/from warehouse , storing place , vehicle or boat.
  • Rates for lengthy goods:

Goods exceeding 12 meters in length and up to 16 meters :additional 50% for respective kinds of cargoes;

Goods exceeding 16 meters in length and up to 20 meters :additional 100% for respective kinds of cargoes;

Goods exceeding 20 meters in length :additional 150% for respective kinds of cargoes;

  • Lightening and additional loading operations proceeded at sea outside port area , additional 10% of the loading/unloading charges shal be added to the charges set for respective kinds of cargoes;
  • Bulk cereals lightened at Luhuashan in Shanghai port , lighterage of RMB 10.00 per ton shall be collected for loading /unloading operations.
  • Cement in jumbo bags , loading/unloading charges shall be collected at 80% of the rare set above for cement in packaged forms.
  • lump sum charges for exported crude oil entered port through pipes.
    • RMB18.10/ton in Dalian Port.
    • RMB16.10/ton in Qinhuangdao Port.
    • RMB16.50/ton in Qingdao Port.
  • Loading/unloading charges for crude oil produced by offshore drilling platform shall be collected at the rate set in this table and lightening lump – sum charges for both imported crude oil and crude oil produced by offshore drilling platform shall be RMB18.10/ton in sea ports and RMB20.90/ton in ports along side the Changjiang River.
  • Bulk liquids with definite terms of delivery at “vessel`s side”, side to/from shore tanks , vehicle or boat” shall be collected at 50% of the rates set in this table for loading (export) or unloading (import) respectively.
  • Settlement of calculating ton for timber:

-1.27 calculating ton per cubic metre for log ;

-1 calculating ton per cubic metre for wood in sawn timber;

-1 calculating ton per cubic metre for lumber in plank form if no dunnae otherwise the ratio shall be consulted between port and cargo owner;

-1 calculating ton per cubic metre for heavy lengthy lumber.

  • Fertilizers in Nos. 1 and 5 refer to those used in agriculture , but used as chemical materials are not included .
  • First grade dangerous goods in No.15 do not include fertilizers and pesticides used in agriculture.

  • Time for hiring boat (except tug) , equipment and handling device shall be calculated from the time when it leaves its base till the time when it returns to its original place; or til the time when the service is completed in case of a separate employment.
  • If hired floating crane is towed by tug, hiring charges for tug shall also be collected.
  • General sweeping of holds does not include cleaning of bilge . Charges for cleaning bilge should be RMB257.00 per hatch. General sweeping and bilge cleaning is inclusive of putting dirt from the hold on deck .If it needs to remove the dirt from vessel, charges for disposal of garbage shall be collected.
  • Charges for disposal of garbage shall be collected once per day regardless of times of disposal . However , no disposal no charges.
  • Charges for washing , sweeping with saw dustas dust as well as other special sweeping shall be collected on the basis of number of workers, with the minimum charges of RMB429.00 per hatch . Charges of materials used in the operation will be additionally collected.
  • Setting , dismantling and conveying rainproof equipment for loading/unloading ,charges of ma/hour shall ne additionally collected at the rates set for ordinary worker.
  • “Special trimming ” refers to the trimming of bulk cargoes for sake of loading other cargoes thereon and other trimming required by ship . But trimming during the process of loading and trimming og hilltop of bulk cargoes coming out of the hatch way after loading as well as general raking of bulk cargoes for loading ballast bags shall not be regarded as special trimming.
  • Charges for water supply and bunkering by port shall be collected in accordance with requlations stipulated by the China Marine Bunker Supply Company.

Notes:

Piloting on the Changjiang River is divided into upper , middle and lower rivers . The basic rate for each of the three parts is RMB0.405 per NRT plus basic rate for distance of RMB0.003315 per NRT/km . The final rates shall be rounded off to RMB0.01.

 

Notes:

  • Calculating ton for harbour dues is the same as the ton for loading/unloading .
  • “Fertilizers” in No. 1 refers to those used for agriculture only , any other fertilizers used as chemical materialsare excluded.
  • “First grade dangerous goods ” in No.3 does not include fertilizers and pesticides for agriculture.
  • Harbour dues on crude oil shall be levied as “goods other than those listed” in No. 2.
  • Harbour dues on other types of containers shall be calculated at the ratio of inner volume of the container with the inner volume of the similar container listed.

Notes:

  • The calculation of self – weight plus twofolds shall be taken in such a way that the gross weight of the cargoes itself is added by twofolds . For example , an empty drum weighs 25kg then the self – weight plus twofolds shall be 25×3=75kg.
  • Charges for cargoes with conversion – weighs shall be calculated according to the conversion – weight even though its atctual weight exceeds the conversion – weight.

RATES OF PORT DUES AND CHARGES ON VESSELS

ENGAGED IN INTERNATIONAL SHIPPING

 

Art.59An additional 20% of the rates of pilotage , tugage , mooring /unmooring charges , berthage and anchorage , loading /unloading charges of No. 10,11,15,16,17 and 18 in Table 4 as well as lump – sum container loading/unloading charges set respectively in the Regulations shall be collected on vessels engaged in East or Southeast Asian routes , except on those engaged in the routes between the coastal ports in South China (coastal ports in Fujian , Guangdong ,Hainan provinces and Guangxi Zhuang Autonomous Region ) and Hong Kong / Macao ).

The near – sea routes refers to the routes between the Chinese ports an dports of countries/regions in East and Southeast Asia.

Art.60“Full size measurement “ refers to the measurement proceeded in accordance with “ Inspection Rules on Gargoes Weighing and Measurements ” issues by Import & Export Commodity Inspection Bureau of the People`s Republic of China.

Art.61Those charged in the Regulations as “heavy lifts ”“first grade dangerous foods ”,“second grade dangerous goods” ,“light bulky goods”, and “lengthy goods”refer to :

“Heavy lifts”refers to those whose weight of each piece is 5 tons or over except goods with conversion -weight , goods on pallets , goods in jumbo bags or unit load and steel products in bundles under 10 tons .

“First grade dangerous goods” refers to those which are stipulated in the “Regulations on Dangerous Goods for Water Transportation of the Ministry of Communications of the People`s Republic of China ”asexplosives , compressed and liquefied gases , flammable liquids of grade 1 , flammable solids of grade 1 , substances liable to spontaneous combustion of grade 1 , substances emitting flammable gases when wet of grade 1 , oxidizing substances of grade 1 , organic peroxides , deadly poisons , radioactive and corrosives of grade 1.

“Second grade dangerous goods” refers to any other dangerous goods that do not come under the category of “first grade dangerous goods” in the “Regulations on Dangerous Goods for Water Transportation of the Ministry of Communications of the People`s Republic of China”. Notwithstanding the above – mentioned dangerous goods , asbestos , fishmeal and fishcrap , cotton , jute and other animal or plant fiber shall not be charged as dangerous goods.

“Light bulky goods” refers to those whose measurement of one weight – ton is 4 cublic meters or more except goods with conversion – weight , assembled vehicles and heavy lifts.

“Lengthy goods” refers to any goods exceeding 12 meters in length .

Art.62Thoes which are not stipulated in the Regulations shall be dealt with according to the “Regulations on Harbour dues and Charges (for domestic trade) of the Ministry of Communications of the People`s Republic of China”.

Art.63The Ministry of Communications of the People`s Republic of China is the authorities for interpretation of these Regulations.

Art.64The Regulations shall be come into effect as from zero hour on June 20th , 1997 . In case of any contradiction between the Regulations and any previous regulations , with the exception of Harbor Dues on vessels , these Regulations shall prevail.

APPENDIX

RULES GOVERNING COLLECTION OF PILOTAGE AND SHIFTING CHARGES ON VESSELS ENGAGED IN INTERNATIONAL SHIPPING ON THE CHANGJIANG RIVER

Art.1These Rules shall apply to the collection of pilotage and shifting charges on vessels engaged in international shipping (including the shipping to/from Hong Kong and Macao) sailing on the Changjiang River and piloted by the Changjiang River Pilot Station.

Art.2Vessels needing piloting shall (or by their agent ) submit an application form of two coppices to the Pilot Station of the Changjiang River 48 hours before the piloting commenced . The Pilot Station shall keep one copy of the form in file , the other copy shall be brought on board by pilot . The master of the vessel an the pilot shall give their signatures on the form after piloting is completed and the form shall be taken as verification for collecting the charges.

Art.3Rates in the Rules are fixed and collected in Renminbi Yuan All disbursements for account of the foreign payer shall be settled in foreign currency at official exchange rate publicized by the People`s Bank of China , whereas the domestic payer shall settle his account in Renminbi Yuan.

Art.4Charging Mode and Calculating Unit

  • For vessels chargeable according to NRT (or GRT if no NRT, or DWT if no GRT) , part of one ton shall be taken as one ton ; for vessels chargeable according to HP (1 HP = 0.735 kilowatt) , part of one HP shall be taken as one HP.
  • For charges payable according to calendar days used , part of one day shall be taken as one day ; for charges payable according to hours used , part of one hour shall be taken as one hour . The odd amount of one hour shall be taken as one hour if it exceeds half an hour or be taken as half an hour if it is less than half an hour.

Art.5Except where payment contract concluded between a payer with the Pilot Station , all charges shall be paid by the payer with the Pilot Station , all charges shall be paid by the payer either in advance or at the time and shall be settled on the date of payment (postponed accordingly for official holidays). Failing which , 5‰ of fine for delaying payment per day from the next day settlement shall be added to the bill . Claims for overcharging or undercharging shall be made within 180 days after the settlement . No refundment whatsoever will be made after the expiration of the said period.

Art.6Pilotage on vessels with pilot on board sailing on the Changjiang River shall be collected on the chargeable distance (in kilometers or the actual distance if no chargeable distance is specified for the port plus NRT of the vessel (HP for tugs) at the rates set in No. 1(A) of “Rates of Pilotage and Shifting Charges on the Changjiang River on Vessels Engaged in International Shipping”(Table 9) on account of times of services rendered .

Art.7Shfting charges on vessels shifting inside port with pilot on board shall be collected for each service rendered at the rate set in No. 2 of Table 9 on account of times of services rendered .

Art.8For piloting vessels to pass through bridges , pilatge for passing bridges shall be added at the rate set in No. 1 (B) of Table 9 on account of times of passing .

Art.9For piloting vessels to pass through locks , pilatge for passing through locks shall be added at the rate set in No. 1 (C) of Table 9 on account of times of passing .

Art.10For vessels under towing , pilotage and shifting charges shall be calculated by adding the HP of the tug to the NRT of the vessel under towing .

Art.11Charges for tug used shall be collected in addition at the rate set for tugage if tug(s) is (are) used in piloting vessels or for shifting .

Art.12500 NRT (or HP) is the minimum tonnage (or HP) for the calculation of shifting charge and pilotage.

Art.13Vessels requiring to call at a port or to change their destination on their way during piloting shall be charged in accordance with the following provisions;

  • To call at a port on their way :charges shall be collected on account of distance from the starting point to the destination regardless whether loading/unloading operations be proceeded.
  • To change their destination : charges shall be collected from the starting point to the changed destination if ships require change before the vessel arrives at the original destination , otherwise additional charges shall be collected on account of the distance from the original destination to the changed destination.

Art.14In case piloting fails to begin on schedule by reason of ship or pilot is kept waiting on board at the request of ship , pilot`s time lost for waiting shall be charged for at the rate set in No. 3 of Table 9.

Art.15Pilot stand – by charge shall be collected on vessels with pilot by reason of the ship , or call at a port on their way (including loading/unloading and embarking/disembarking) as well as waiting in port for return (including loading/unloading and embarking/disembarking) , at the rate set in No.4 of Table 9.

No pilot stand – by charges shall be collected for the time when ailing restricted by channel depth or night – sailing can not be rendered.

Art.16Traffic charges for pilot shall be collected at the rates set in No.5 (A.B) of Table 9 on account of each piloting or shifting .

Art.17Pilot surcharges shall be collected when piloting or shifting required by ship on official holidays of the People`s Republic of China or on night shifts at the rates set in No.6 (A.B) of Table 9.

Art.18Charges for time lost for waiting , stand – by time and surcharges collected on account of the number of pilots shall be limited within 3 persons per time . No charges shall be collected for the exceeded pilots or apprentice pilots.

CHAPTER GENERAL PROVISIONS

Art.1 The Regulations shall apply to harbour dues and charges levied and collected on vessel engaged in international shipping and on imported or exported cargoes in international trade in the port of the People`s Republic of China.

Except where specified otherwise , harbour dues and charges on transportation between the above – mentioned ports and Hong Kong / Macao and on cruise ships shall be levied and collected in the lighet of the Regulations.

Art.2Rates in the Regulations are fixed and collected in Renmindbi Yuan. All disbursements for account of the foreign payer shall be settled in foreign currency at official exchange rate publicized by the People/s Bank of Chna, whereas the domestic payer shall his account in Renminbi Yuan.

Art.3Ship or its agent shall shall submit to the port and other concerning departments in writing ,no later than the date of vessel/s arrival , the therms and conditions stipulated in C/P and /or contract of affreightment in connection with the responsibility for the payment of harbour dues and charges, failing which the accounts shall be settled with the agent . Should there be something wrong in import/export manifest or other information submitted by the ship or its agent or it needs to be changed ,ship or its agent shall notify the port and other conecerning departments in writhing before loading/unloading .

Art.4Charging Mode and Calcul ating Unit

  • For vessels chargeable according to NRT (or GRT if no NRT, or DWT if no GRT),part of one ton shall be taken as oneton ; For vessels chargeable according to HP(1 HP= 0.735 kilowatt), part of one HP shall be taken as one HP.

For vessels with no NRT, nor GRT, nor DWT, harbour des and charges shall be collected as to the weight of 500 toms.

  • For charges payable according to calendar days used,

Except where specified otherwise , part of one day shall be taken as one day ; for charges payable according to hours used , part of one hour shall be taken as one hour, The odd amount of one hour shall be taken as one hour if it exceeds half an hour or be taken as half an hour if it is less than half an hour.

  • For containers , harbour dues and charges shall be collected according to the units of container , As for empty folded container , four or less than four such containers packed up together shall be regarded as one such full standard container .
  • Cargoes shall be calculated either in metric ton (W) of 1000 kilograms or in measurement ton (M) of I cubic meter .The metric ton is on the basis of gross weight of cargoes . The measurement ton is on the basis of full size volume of cargoes . For cargoes which can be calculated either in measurement ton or in metric ton , harbour dues and charges shall be levied and collected according to the bigger one .

Cargoes fixed with conversion – weight ratio shall be charged according to “Conversion Table of Cargoes Weight” (Table 1).

  • The minimum weight or measurement taken for each kind of cargoes on each B/L or Shipping Order is one calculating ton ; any fraction exceeding one calculating ton shall be calculated in round figures with minimum unit of 0.01 calculating ton . Cargoes in the same class shall be aggregated and any fractions thereof shall be rounded up .
  • The minimum calculating unit of odd amount charged on cargoes under each B/L or Shipping Order is RMB 1.00 , and fraction below RMB 1.00 shall be calculated in round figures as RMB 10.00.
  • Detailed information on heavy lifts , lengthy goods , light bulky goods and dangerous goods shall be provided either by cargo owner or by ship on the date of arrival of the vessel ,otherwise all charges shall be collected according to the highest rates fixed on cargoes under B/L or Shipping Order .

Art.5For import / export cargoes , the amount of weight / measurement on B/L or Shipping Order shall be taken . The port may reexamine the amount of cargoes . If the amount reexamined or spot checked is different from that on B/l or Shipping Order , harbour dues and charges shall be collected in accordance with amount reexamined or spot checked jointly by port and ship , cargo owner or their agent.

Art.6Except where payment contract concluded between a port and a payer ,all charges shall be paid by the payer either in advance or at the time and shall be settled on the date of payment (postponed accordingly for official holidays ) , failing which 5‰ of fine for delaying payment per day from the next day of settlement shall be added to the bill . Claims for overcharging or undercharging shall be made within 180 days after the settlement . No refoundment whatsoever will be made after the expiration of the said period.

Art.7After vessel/s arrival and at the request of ship or cargo owner , operations and services regulated under articles 9,10,11,16,17,18,25,27,31,32,33,34,35,36,49,50 and 51 (excluding rain proof equipment for loading / unloading , rain tent , cushioning ,oil fence and water supply) of the Regulations are to be performed on official holidays of the People/s Republic of China and /or on night shifts , surcharges shall be collected from the applicant .

Surcharges for holiday / night shift services shall be collected at 5% of the basic rates set respectively for normal working days and surcharges for night shift services on holidays shall be collected at 100% of the basic rates set respectively for normal working days.

Time for night shift shall be calculated 8hours per day . Time to commence and to terminate for calculating holiday and night shift surcharges shall be fixed and publicized by port authority itself.

Art.8International transit goods refers to goods of a foreign country transshipped through port of the People/s Republic of China in the following ways to that country or to a third country :

  • Vessel to vessel transshipment ;
  • Vessel to rail transshipment ;
  • Rail to vessel transshipment ;
  • Vessel to truch transshipment ;
  • Truk to vessel transshipment .

Excep goods in container , no transshipment shall be made for bulk oil , first grade dangerous goods , fresh cargoes , refrigerated goods , livestock and animals .

CHAPTER Ⅱ PILOTAGE AND SHIFTING CHARGES

Art.9Pilotage on vessels entering or leaving port with pilot on board shall be collected according to the following regulations :

  • For port of piloting distance within 10 nautical miles , pilotage shall be collected at the rate set in NO.1(A) under “Pates of Harbour dues and Charges on Vessels Engaged in International Trade”(Table 2)
  • For port of piloting distance exceeding 10 nautical miles , additional pilotage shall be collected on the exceeded distance at the rate set in NO.1(B) of Table 2 in addition to normal pilotage.
  • For piloting beyond port piloting area , an additional pilotage shall be collected on the excess distance at 30% of the rate set in No.1(A) of Table 2.
  • Except the pilotage specified in 1) and 2) in this Article , piloting surcharges for non – base port may be collected in ports other than Dalian , Yingkou ,Qinhuangdao , Tianjin , Qingdao , Rizhao,Lianyungang, Shanghai ,Xia man ,Shenzhen , Guangzhou , Zhanjing ,Fangcheng , Haikou , Yangpu , Batsuo and sanya on account of their own conditions .

However , the maximum surcharges shall not exeeed RMB0.30 per NRT.

The piloting distance of port shall be publicizd by the port authorities respectively and be filed with the Ministry of Communications .

Pilotage shall be collected respectively on the first entry and last departure of port.

Art.10Shifting charges on vessels moving inside port with pilot on board shall be collected for each service rendered at the rate set in No.2 of Table 2.

Art.11Charges for tugs used piloting vessels to pass through locks , pilotage shall be collected according to times of passing at the rate set in No.1 (C) of Table 2.

Art.12No additional charge shall be collected on launches used by pilots.

Art.13For vessels under towing pilotage and shifting charges shall be calculated by adding HP of the tg to the NRT of the vessel under towing.

Art.14Charges for tugs used shall be collected in addition at the rate set for tugage if tug(s) is (are) used in piloting vssels or for shifting berths.

Art.15500 NRT (or HP) is the minimum tonnage (or HP) for the calculation of shifting charge and pilotage.

Art.16In case piloting fails to begin on schedule by reason of ship or pilot is kept waiting on board at the request of ship, pilot/s time lost for waiting shall be charged for at the rate set in No.3 of Table 2.

Art.17Pilotage and shifting charges on vessels engaged in international shipping on the Changjiang River shall be collected in accordance with “Rules Governing Collection of Pilotage and Shifting Charges on Vessels Engaged in International Shipping on the Changjiang River”.

CHAPTERⅢTUGAGE

Art.18Charges for hiring port tugs shall be collected from applicant at the rate set in “Rates of Hire of Boats, Equipments , Handling Devices and for Miscellaneous Services Applied ” (Table 7) according to the time of tug used and HP of the tug.

The time of tug used is divided into actual operation period and assistant operation period . The actual operation period is the time when tug arrives at the working site and begins to work till the tug finishes its services. The assistant operation period is the time that tug processes from its berthing base to the working site and back from the working site to it′s berthing base . The actual operation period shall be confirmed in signature by the entrustor and be charged according to the time actually used . The assistant operation period shall be fixed and filed with the Ministry of Communications by port authorities and be charged in the term of lump-sum charges.

CHAPTER IV MOORING/UNMOORING CHARGES

Art.19Mooring/unmooring charges on vessels shall be collected separately for each mooring/unmooring service rendered by stevedores at the rates set in No.4 (A.B.C and D) of table 2.

Charges for every additional mooring service shall be collected while vessel is berthing in port.

CHAPTER V BERTHAGE/ANCHORAGE

Art.20Berthage shall be charged by owner of the terminal/buoys to vessels berthing at wharf or mooring buoys at the rate set in No.5 (A) of Table 2.

Art.21Anchorage shall be levied by port authorities on vessels anchored in port at the rate set in No.5 (B) of Table 2.

Art.22Berthing time of vessel staying at wharf , buoys or anchorage shall be calculated as per one day of 24 hours . Less than 24 hours shall be also calculated as one day.

Art.23Berthage shall be charged by owner of the terminal to following vessels berthing at wharf at the rate set in No.5(C) of Table 2:

  • Remaining in berth 4 hours after completion of loading/unloading or embarking/disembarking (that means the delivery procedures have been completed) y reasons of the ship.
  • Waiting for repair or under repair not caused by port , except while waiting for loading/unloading or in the process of loading/unloading.
  • Remaining in berth after bunkering and/or water supply.
  • Vessels loaded/unloaded other than port stevedores.
  • International cruise ship (except on the Heilongjiang River and on the main route of the Changjiang River).

Art.24No berthage shall be collected on vessels remaining in berth caused by port.

Art.25Berthage on vessels calling alongside vessels at wharf or buoys shall be collected as on vessels at wharf or buoys.

Art.26Vessels calling more than one Chinese port in the same voyage , berthage and anchorage shall be levied at normal rate in the first port and 30% discount shall be given from the second port.

CHAPTER VI CHARGES FOR OPENING/CLOSING HATCHES

Art.27Charges for opening and/or closing hatches by port stevedores shall be collected separately at the rates set in No.6 (A.B.) of Table 2 for unloading and/or loading operations , with each operation counted as one opening and one closing of hatches , irrespective of number of decks and times of opening/closing.

Removing or replacing vessel′sbeam alone by port stevedores shall be regarded as opening/closing hatches and be charged accordingly.

Art.28One large hatch (also known as A-B hatch) with crossing beams (including fixed and movable ones) in the middle shall be regarded as two ordinary hatches and be charged accordingly.

Charges for opening and/or closing small hatches outside ordinary ones shall be collected at the ratio of four(small hatches), or less than four for the total or remaining, to one (ordinary hatch).

Art.29Charges for opening/closing hatches of full container vessel with specialized container handling devices shall be collected as one opening for unloading operation and one closing for loading operation irrespective of the times actually occurred at the rate set in No.6(C) of Table 2. For loading or unloading operation only , one opening and one closing charge shall be collected.

CHAPTER VII HARBOUR DUES ON GOODS

Art.33Loading/unloading charges shall be collected on bulk and general cargoes loaded and unloaded on/from vessels in port according to the rates set in “Rates of Loading/Unloading Chargeson Imported/Exported Cargoes” (Table 4)

Art.34Whether to use ship′sgear or to use port handling device for loading/unloading is a matter to be decided by the port on account of the operation .If ship′s gear is used, loading/unloading charges shall be collected at the rates set in Table 4 together with winchmen charges set in No.7(A,B) of Table 2.

Art.35In addition to loading/unloading charges for using ship′s gear set in Table 4, charges for using floating crane under application shall be also collected from the applicant according to the actual hiring charges if it is so applied for loading/unloading operations . With the permission of port to use floating cranes provided by cargo owner or vessel , the loading/unloading charges shall be collected at the rates set for loading/unloading charges of using ship′s gear in Table 4.

Art.36In case cargoes in package are to be loaded in bulk by cutting and emptying the bags on board or in case cargoes in bulk is to be filled in bags at vessel′s holds before discharging , loading/unloading charges shall be collected according to the rates set for cargoes in package together with charges for cutting ,emptying ,filling and sewing bags at the rates set in Table 7.

Art.37Shifting operations of bulk and general cargoes are divided into shifting on board and shifting off board.

Charges for shifting on board shall be collected according to labor charges at the rates set in Table 7. If port handling devices is used in the operations , charges for using them shall be additionally collected.

Charges for shifting off board shall be collected according to the expenses actually incurred in the operation.

Art.38Loading/unloading cargoes/vehicles operations in roll – roll manner , when using port power and stevedores , loading /unloading charges shall be collected at 80% of the rates set for using ship′s gear in Table 4. When using port stevedores only , loading/unloading charges shall be collected at 50% of the rates set for using ship′s gear in Table 4. When using neither port power nor stevedores , loading/unloading charges shall be collected at 30% of the rates set for using ship′s gear in Table 4.

Art.39Lump – sum charges for loading/unloading operations of containers in port shall be collected from ship according to the rates set in “Rates of Lump – sum charges for Loading/Unloading Inward/outward containers in Foreign Trade and Rates of Lump -sum charges for International Containers in Transit”(Table 5)

The overall operations of loading/unloading containers include:

  • For inward full container : dismantling ordinary securing materials of containers , unloading containers from vessel to container yard , stacking the containers according to their types , loading the containers on cargo owner′s truck or transporting the containers to container freight station (or warehouse) within the same terminal and thereafter unloading the empty containers from cargo owner′s truck to container yard or returning the empty containers from container freight station (or warehouse ) within the terminal to container yard.
  • For outward full container : loading empty containers from container yard to cargo owner′s truck or transporting the empty containers from container yard to container freight station within the sane terminal , thereafter unloading the full containers from cargo owner′s truck to container yard (or warehouse) or returning the full containers from container freight station (or warehouse) within the same terminal to container yard .stacking the containers according to their types ,loading the containers on board vessel and making ordinary securing.
  • For inward empty container : dismantling ordinary securing materials for empty containers , unloading the containers from vessel to container yard , stacking the containers according to their types.
  • For outward empty container : loading empty containers on board vessel from container yard and making ordinary securing .
  • The overall operations shall also include inspecting containers , weighing full containers and preparing relevant documents.

Art.40When no gear is provided by ship and shore handling devices or floating cranes are provided by port in the operation of loading/unloading containers at unspecialized container terminal for container vessels , additional charges for using shore handling devices shall be collected at 15% of the rates of loading/unloading lump – sum charges set for respective types of containers if shore handling device is used , or additional charges for using floating cranes shall be collected if floating crane is used , together with loading/unloading charges in lump – sum set in Table 5.

Loading/unloading containers carried by roll – roll vessels at specialized container terminal in “ lift on/lift off ”manner with shore crane or ship`s gear , or at unspecialized container terminal in “lift on/lift off ”manner with ship`sgear , lump -sum charges shall be collected at the rates setin Table 5 . Loading/unloading containers at unspecialized container terminal in “lift on/lift off” method with shore crane , except the lump – sum charges set in Table 5 additional charges for using shore crane shall be collected at 15% of the rates of lump – sum charges set for respective types of containers . If forklifts are also used in auxiliary operations in vessel`s holds , hiring charges for using forklifts shall be collected additionally.

Loading/unloading containers with chassis or bogie in “roll on/roll off” manner , lump – sum charges shall be collected at the rates set in Table 5 when port trailers are used or at 50% of the rates set in Table 5 if vessel`s trailers are used.

Art.41Loading/unloading containers shipped in interior – feeder service , lump – sum charges shall be collected at 90% of the rates set in Table 5.

Art.42Loading/unloading containers from terminal to vessel at anchorage (or buoys) , or vice versa , by barges , loading/unloading charges for barges and lighterage shall be collected in addition to the lump –sum charges set in Table 5.

Art.43General cargoes picked up additionally by container vessel which are not suitable for roll – roll operation , loading/unloading charges at specialized container terminal shall be collected at one fold of the rates set in Table 4 for the same kind of cargoes.

Art.44Loading/unloading containers ( excluding fastening and removing securing ) carried by truck , train or barge which are not included in overall operations , loading/unloading charges shall be collected at the rates set in “Rates of Charges for loading/Unloading Containers Carried by Trucks , Trains or Barges and Rates of Charges for Moving and Shifting Containers “ (Table 6)

Art.45Containers moved within terminal , moving charges shall be collected from responsible party or applicant at the rates set in Table 6 on account of times of actual moving .

Moving charges shall applied to the following conditions :

  • Containers moved between vessel`s side and container yard other than the responsibility of port.
  • Containers moved resulting from custom clearance , inspection , repairing , washing and/or fumigating.
  • Necessary moving considered by port after 10 days storage in port for delivery as FCL.
  • Moving caused by ship`s or cargo owner`s responsibility.
  • Moving at request of ship or cargo owner.

Art.46 At the request of ship or cargo owner , or owing to their responsibility , the port shifts containers on board vessel , charges for shifting containers shall be collected from responsible party or applicant at the rates set in Table 6 on account of times of actual shifting .

When no ship`s gear is provided and shore handling devices or floating cranes are provided by port in the operation of shifting containers on board vessel at unspecialized container terminal , additional charges for using shore handling devices shall be collected at 15% of the rates set for overall operations for respective types of containers if shore handling device is used , or additional charges for using floating crane shall be collected if floating crane is used , apert from the shifting charges set in Table 6.

If it is necessary to move containers into container yard in shifting operations , two times of moving charges shall be collected in addition to shifting charges.

Art.47Vanning / devanning containers at CFS , lump – sum charges for vanning/devanning containers shall be collected from ship (CFS delivery) or from cargo owner (vanning/devanning containers at cargo owner`s request) at the rates set in Table 7.

The overall operations of vanning/devanning containers include:

  • Devanning : dismantling ordinary lashing materials inside containers , taking out the cargoes from container and stacking , loading the cargoes on cargo owners truck (stowing cargoes on truck is not included) , preparing documents and general sweeping of the empty containers.
  • Vanning : unloading cargoes from cargo owner`s truck (un – stowing on truck is not included) to CFS (or warehouse) , vanning and securing the cargo inside container , preparing documents and general sweeping of empty containers.

Art.48International imported cargoes/containers carried by vessels which are not unloaded in the port but continually transported by the same vessel to other ports in China after documents changed on their way , or domestic exported cargoes/containers carried by vessels which are not unloaded but continually transported by the same vessel to foreign ports after documents changed on their way , loading/unloading charges and lump – sum charges for loading/unloading shall be collected separately at the port of destination or port of origin at the rates set in Table 4 or Table 5.

Art.49Should transshipment between main routes and feeder services of empty/full containers in port be necessary , rates of lump – sum charges for transshipment of containers shall be fixed by ports respectively according to the local conditions and then be filed with the Ministry of Communications.

Scope of overall operations :from unloading containers from a vessel to loading the containers on the other vessel .

Art.50Loading/unloading charges for international bulk and general cargoes in transit shall be collected at 70& of the rates set in Table 4.

Art 51Lump – sum transit charges for international containers in transet shall be collected from ship at rates set in Table 5.

Scope of overall operations : from unloading containers from a vessel (truck) to loading the containers on the truck (vessel).

CHAPTERIX LABOR CHARGES

Art.52Labor charges for technical conductor (foreman) assigned by port to conduct loading/unloading operations of assembled vehicles , dangerous foods , lengthygoods and heavy lifts (excluding steel ingots and billet shall be collected in accordance with Table 7.

Art.53Labor charges for working hours for the following operations rendered at the request of ship or cargo owner shall be collected from the applicant according to Table 7 and on account of the number of stevedored :

  • Breaking , shoveling , shaving or pulling melted , frozen or solidified cargoes during hard loading/unloading operations ;
  • Except where specified otherwise in these Regulations , lashing/unlashing , reinforcing , dunnaging , separating special cleaning of container or any other miscellaneous operations.

The entrusting party shall provide materials needed for the abve – mentioned operations. Charges for using port handling devices shall be collected additionally if port devices are used .

CHAPTER X MISCELLANEOUS

Art.54Charges for hiring port boat , handling device or equipment , miscellaneous services carried out by port stevedores under application of cargo owner or ship as well as charges for standing by of workers caused by ship shall be collected at the rates set in Table 7.

Art.55Charges for hiring wharf or buoys to supply oil or water shall be collected in accordance with agreement reached between renting an hiring parties .

Art.56Containers passin grail tracks in port , charges for using tracks shall be collected in accordance with “ Rates of Charges on Containers Using Rail Tracks and Rates of Container Delivering Charges by train” (Table 8) .

Art.57Containers delivered by port train , charges for delivery shall be collected in accordance with Table 8.

Art.58Should exported cargoes and containers are retracted from customs , charges for retracting shall be collected from cargo owner on account of operations actually rendered.
